Louisiana truck accidents: Good Samaritan killed on I-10

A Louisiana man was killed on the morning of Nov. 22 while trying to help a woman whose U-Haul had become detached from her vehicle. An oncoming tractor-trailer struck the U-Haul and the woman's car, then hit the woman and the man who stopped to lend her assistance. As is all too frequently the case in truck accidents, the resulting damages were significant and led to severe injury and loss of life.

The incident occurred around 1:27 a.m. when the woman was traveling over an overpass on I-10 westbound near Henderson. Per investigators, the U-Haul trailer had separated from the woman's Volkswagon. Another driver, the 25-year-old Lafayette man, spotted the trailer where it came to rest in the westbound Interstate 10 lane and stopped to help.

They were both attempting to remove the U-Haul from the roadway when a 1989 Peterbilt tractor-trailer attempted to swerve right to avoid hitting the U-Haul. His attempt was unsuccessful. The tractor-trailer collided with the U-Haul and the Volkswagon, subsequently crashing into both the man -- who was pronounced dead at the scene by the St. Martin Parish Coroner's Office -- and the woman, who was critically injured. The 81-year-old tractor-trailer driver voluntarily submitted to a sobriety test, with negative results.

Despite the fact that Louisiana State Police do not believe impairment was a factor in the automobile accident, if negligence on the part of the truck driver is apparent, the deceased's family members may choose to file a wrongful death suit against the driver and possibly the trucking company for which he was working at the time of the crash. In addition, the woman whose trailer became disconnected, in essence contributing to the accident, could also be named as a defendant by the family of the deceased good Samaritan.
