A man is seeking unspecified damages in a court case after a collision four years ago resulted in the amputation of a leg. The motorcycle accident occurred on Louisiana Highway 3017 when the plaintiff’s motorcycle was struck by the defendant’s vehicle on June 23, 2012. The suit has been filed against the driver of the vehicle, several insurance companies and a medical center.
The defendants include not only the driver and her automobile insurance agency, State Farm Mutual, but also the Ochsner Medical Center Emergency Department and its insurer, ABC insurance company. A doctor from the medical center and his insurer are additional defendants. They are all accused of negligence.
According to the claim, the driver involved in the accident had been admitted to the Ochsner Medical Center emergency room earlier in the day. She was given medication but then allegedly released while still under the effects of the prescribed drugs. This, purportedly, was a contributing factor in the crash between her car and the motorcycle that eventually resulted in the amputation of the plaintiff’s left leg.
Car crashes are almost always damaging to some degree, but a motorcycle accident can be extremely destructive and injurious. Residents of Louisiana who have been the victims of a crash while on a motorcycle due to another’s negligence may choose to file a personal injury claim. An experienced attorney can help the injured seek monetary compensation that can be used toward, among other things, wages lost due to injury, medical bills and the victim’s pain and suffering.
