Most people make sure that their vehicles are properly maintained and have sufficient fuel. However, that does not always prevent their vehicles from breaking down. Whenever a vehicle breaks down on the side of the highway, the risk of a car accident increases. Recently, the Louisiana State Police took the opportunity to remind and caution drivers to move into the left hand lane on multi-lane roadways to give a stranded motorist extra room.
This warning was issued in the aftermath of a crash that took the life of a Louisiana man. The preliminary report indicates that his car had broken down on Highway 171. He had gotten out of his vehicle as a southbound vehicle approached him. For some reason, the small SUV left the lane of travel and struck the man.
The victim initially survived the crash and was taken to University Health in Shreveport. Sadly, the man’s injuries were too severe, and medical personnel were unable to save his life. Troopers with the Louisiana State Police do not believe that impairment was a factor. However, per protocol, toxicology samples were sent for analysis.
Even if no criminal charges are filed against the 17-year-old driver, the family of the victim could file a wrongful death claim against the driver and any other party with an ownership interest in the car she was driving. Establishing negligence in a civil court action could result in an award of damages. Any monetary restitution the family receives could help with the financial losses incurred in the aftermath of the car accident.
