1 dies, 1 survives car accident at Louisiana intersection

Each year, numerous accidents occur at Louisiana intersections. Drivers fail to make sure the intersection is clear of vehicles, observe approaching traffic, obey traffic devices or pay sufficient attention due to impairment or distracted driving. In the immediate aftermath of a car accident, the factors leading to it may not seem important. However, at some point, the details could make all the difference when it comes to proving negligence in a wrongful death or personal injury lawsuit.

For instance, determining what caused a driver to pull out in front of another  vehicle could be important to the driver of the other vehicle. Louisiana State Police troopers are attempting to make that determination as part of their investigation into a recent car accident. The 57-year-old woman who was driving the car believed to have caused the crash initially survived and was taken to an area hospital. Ultimately, she died from her injuries.

The woman's vehicle came to a stop before she continued into the path of the other vehicle. The 42-year-old woman driving that vehicle also suffered injuries for which she was transported to a hospital in the area. Impairment is not suspected, but routine toxicology tests are being run to verify.

As the investigation continues, the surviving driver may face a significant recovery time, which often comes with significant financial losses. She may exercise her right to file a personal injury claim against the estate of the deceased woman. Successfully establishing negligence could lead to an award of monetary damages to help with the financial burdens incurred in the aftermath of the car accident.
