What caused woman to black out and cause a deadly car accident?

| Sep 30, 2015 | Car Accidents

By their very nature, Louisiana accidents are unpredictable. Innocent people can go about their lives without any idea that they are going to become the victim of a car accident. For example, a man who was standing outside talking to another person had no way of knowing that he was in the wrong place at the wrong time — and it cost him his life.

The woman behind the wheel of a car that crashed into him claims she blacked out before she lost control of her vehicle. The out-of-control vehicle struck a pickup truck. In turn, the pickup struck and killed the man. A local resident witnessed the accident and ran to get help, but it was too late.

The car driver was hospitalized with unknown injuries. So far, no citations or criminal charges have been filed, though the investigation is said to be ongoing. Police are looking into what might have caused the woman to lose consciousness. A toxicology sample was taken from the woman in order to determine whether she was impaired at the time of the crash.

In the meantime, the family of the deceased victim may exercise its right to file a wrongful death claim against the driver. Negligence must first be proved through appropriate evidence before a Louisiana court will consider claims for specific items of monetary damages. If the court determines that the driver was negligent in causing the fatal car accident, the family could receive a monetary judgment to help defray the financial burdens this family is left with in the aftermath of this tragedy.
