The recent death of a motorcycle rider prompted troopers with the Louisiana State Police to remind drivers to be vigilant while pulling out of driveways, making turns and changing roadways. This warning comes too late for the motorcyclist that suffered fatal wounds in a recent crash involving a turning pickup truck. The investigation into this death is ongoing.
Preliminary reports from the Louisiana State Police indicate that a pickup truck was heading westbound on LA 14. At the same time, a late model motorcycle was heading in the opposite direction. The driver of the pickup failed to yield the right-of-way to the motorcycle as it made a left turn.
The biker was unable to avoid a collision. The impact threw the man off his motorcycle and slammed him into the pavement. The driver of the pickup did not suffer any injuries, but the motorcyclist died as a result of the injuries he suffered during the crash.
It was determined through a breath test that the pickup truck driver was not impaired, and a toxicology sample was taken from the deceased victim for testing, which is routine in fatal accidents. It was not reported whether any charges have been filed against the driver. That determination may be awaiting the results of the investigation.
The family of the deceased victim does not have to wait for the results in order to file a wrongful death claim against the driver, however. If it is shown that the fatal wounds suffered by the motorcycle rider were caused by the negligence of the driver of the pickup, the family may be awarded damages. Any financial restitution received could help defray the costs incurred due to the death of their loved one.
